I NEED A LAYWER

If you have you determined a lawyer is in your best interest, let’s cover some important topics and help you find an attorney.

POWER NOTE: IF YOU NEED A LAWYER, YOU NEED A LABOR ATTORNEY WHO IS KNOWLEDGEABLE AND CERTIFIED TO PRACTICE IN THE STATE YOU ARE EMPLOYED, OR THE AGREEMENT HAS JURISDICTION.
Different States have different laws. Do not settle for just any attorney.  Be confident in their experience and the scope of their advice. 

PICKING AN ATTORNEY
Interview (on the phone) more than one attorney. Ask for their severance agreement philosophy. Is it in line with your approach? Make sure you discuss their philosophy, fees, and any conflicts of interest they may have.

ATTORNEY NOTE ON FEES
Many attorneys will give you a reduced fee or even free consultation advice. They will not tell you this, but the attorney is really looking for that "pay day" - the lawsuit. They hope you have been wrongfully terminated so they can cash in on the big win. Sure, they will help you negotiate if you like, but their fees can be quite expensive: $200 - $400 per hour. Be smart and understand their intent and how it works with your strategy.

SETTING THE FEE
Many attorneys will offer a fixed fee to consult. In the end, you are paying them by the hour. Get this amount agreed to early if you move forward. In the end, they make money for hours billed and lawsuits. Keep this in mind. You are looking for help, only in the rarest cases are you looking for long term legal assistance. Make sure the clock (and your pocketbook) are not subject to their will.

BE WARY OF ATTORNEY'S WHO...

  • Want to contact the company on your behalf.

  • Want to meet with your company to negotiate.

  • Start discussing litigation points. You are looking to move on, not be stuck in court paying legal fees.

  • If your attorney suggests litigation, or more formal discussions with your employer, get a second opinion.

HOW TO FIND AN ATTORNEY
It is not necessary to find an attorney within driving distance, almost all legal matters can be done over the phone. Remember very few cases actually go to court.
